TERMS AND CONDITIONS CASA LA MARIPOSA

These terms and conditions apply to all (rental) agreements the guest enters into with Casa La Mariposa, whether via the website, email, phone or otherwise. The guest accepted these terms and conditions when confirming the booking. Once the property has been booked and (partly) paid for, the rules below apply and the guest agrees to these provisions.

Casa La Mariposa –  Casa La Mariposa is a holiday home located in Ciudad Quesada, Calle Gijon 50, Puerta 27, 03170 Rojales, Alicante, Spain. The property is offered for rent all year round via various platforms, including Booking.com, as well as via its own website www.casalamariposa.eu.

Holiday home – The website describes what a guest can expect from the holiday home, which special items are present and what the special provisions are.

Inventory – A complete inventory list of everything present in the property hangs in the kitchen. If anything is missing, please report it to the host immediately. Furniture is not listed on this list and must be left complete.

Booking – A booking is made via the website www.casalamariposa.eu or via a booking platform such as Booking.com. The guest must be over 25 years of age and Casa La Mariposa reserves the right to request approved identification to verify age.

Formation and content of the agreement – The agreement between Casa La Mariposa and the guest is concluded when the guest accepts the offer of Casa La Mariposa as stated on the website. This happens after the booking form completed by the guest has been received by Casa La Mariposa, payment has been made by the guest and confirmation has been sent by Casa La Mariposa. The confirmation states the period for which the guest has registered, as well as the check-in and check-out times and the location of the holiday address.

Rental price – An up-to-date overview of the rental prices can be found on the website. Mandatory additional items are bed linen/towels and cleaning costs. Electricity and water are included in the rental price. If electricity use exceeds 110 kWh per week, then per kWh
€0.40 is deducted from the deposit.

Cleaning costs – The guest must pay cleaning costs and bed linen/towels in addition to the rental price, to cover the cleaning and inspection of the property, as well as laundering the linen and towels. Each guest always receives one linen package: a small and a large towel p.p., a guest towel per bathroom and 2 kitchen towels. Beach towels can be rented separately.

For stays longer than 2 weeks, an extra cleaning is mandatory, so the property is checked every 2 weeks.

Care of the holiday home – The guest pays for cleaning and laundry services. This does not alter the fact that the guest is obliged to take care of the property during their stay.

The property is delivered clean, including made-up beds, towels, toilet paper, washing-up liquid and hand soap. If the guest is not satisfied with these items on arrival, they must give feedback to the host so the problem can be resolved as quickly as possible. If no feedback is given, we assume everything is in order.

Although cleaning costs are charged, the guest must remove all food remains before check-out, take the rubbish to the bins outside and store all kitchen utensils clean.

Deposit – Upon acceptance of the rental agreement, a security deposit of €500 must be paid to cover any significant damage or misuse of the property. The owner or manager reserves the right to draw from this deposit the funds needed to pay for necessary repairs resulting from such damage. This deposit is refunded within 10 days after check-out and after inspection by the host.

Payment – 
Payment is made through Stripe's secure server. To confirm the booking, the guest must pay the rental price, including the additional costs and the deposit. This arrangement may be deviated from only if both parties agree.

Car – In some cases our car, a Ford Fiesta, can be booked as an extra. Additional provisions will be sent separately, if applicable.

Check-in & check-out – The keys to the accommodation are provided on site. Check-in starts at 16:00 on the first day of the contract and guests must check out no later than 10:00 on the last day. The exact check-in and check-out times are agreed in advance between the guest and the host. Extra days can often be booked up to the last day, subject to availability, although extension surcharges vary. If a guest does not check out on time, Casa La Mariposa reserves the right to withhold an additional amount of up to €250 from the deposit.

Community house rules – Casa La Mariposa is located in a small community of 20 apartments. House rules apply here and are added as an appendix. Guests of Casa La Mariposa, as well as other visitors, must comply with these rules during their stay. Violation of these rules may lead to eviction from the property and a fine.

House rules Casa La Mariposa –
Casa La Mariposa also has house rules. These can be found in the information folder on the dining table. The guest always reads them carefully within 24 hours of the start of the rental and must comply with these living rules. Failure to do so may result in removal from the property.

The guest is responsible for the property and all equipment during the rental period and undertakes to compensate for all damage that may be caused by them or those staying in the property on their behalf during the rental period. The guest must also inform the host of any damage.

Below we highlight the most important house rules:

  • The total number of guests in the property may not exceed five. One additional baby is allowed on top of this number;
  • Non-paying guests are allowed during the day but may not stay overnight;
  • Pets are not allowed;
  • Smoking is not allowed indoors, nor outside on the artificial grass;
  • When the guest leaves the property, the alarm must always be switched on;
  • Always respect the neighbours and keep noise to a reasonable minimum;
  • Guests are asked to bear in mind that homeowners are responsible for the behaviour of guests towards neighbours;
  • If a guest's behaviour causes significant nuisance, Casa La Mariposa reserves the right to evict the guest and refuse a refund;
  • Treat the property well and keep it reasonably clean during your stay;
  • A gas burner (e.g. for paella) in and around the house is absolutely NOT allowed!;
  • Guests should be careful at the pool and make sure their children are too.

On departure from Casa La Mariposa – The guest pays attention to the following items when leaving the property at the end of the holiday period. Below is an overview of the most important items:

  • Put dirty towels and bed linen together in the hallway;
  • Put the rubbish in the bin by the street;
  • Empty the dishwasher;
  • Wipe down the table top;
  • Vacuum the floors;
  • Switch off the air conditioning;
  • Do not turn on the tumble dryer;
  • Close all windows, doors and shutters;

Other items are listed in the information booklet on the table. The guest must follow these instructions.

Refusal by Casa La Mariposa –If the guest violates the instructions and/or rules,
Casa La Mariposa has the right, without giving reasons, to deny (further) stay in this property, without refund of the rental amount.

Transfer –
A holiday booked with Casa La Mariposa is tied to a name. This means a guest cannot simply transfer their booked trip to someone else. This is always coordinated with Casa La Mariposa, well before the rental period starts.

Non-bookable periods –
Casa La Mariposa lists the non-bookable periods on its website and always plans a year ahead. If a guest wishes to book a period beyond this term, the guest can contact Casa La Mariposa.

Prolonged force majeure –
In the event of prolonged force majeure, Casa La Mariposa may suspend the rental period until the situation has returned to normal. In this case Casa La Mariposa will refund the rental amount for the period in which the holiday could not take place.

Price increase – Rental rates may be adjusted each calendar year, without stating reasons.

Changing the holiday period –
If the guest wishes to change their holiday period, this is always requested by email, and availability and price difference are reviewed in consultation with Casa La Mariposa.

Suspending the rental period –
Suspension of a rental period only happens in very serious, medical cases. Always in consultation with Casa La Mariposa.

Cancelling a booked trip – If a cancellation is necessary after confirmation of the booking, please contact us in writing at info@casalamariposa.eu. Casa La Mariposa will make an effort to accommodate the guest with a change to the booking, but cannot guarantee that such a request will be met without charge.

Any down payments and additional mandatory costs are non-refundable. The remaining amount will be refunded if the cancellation takes place no later than 30 days before check-in. After these 30 days, the booked trip can no longer be cancelled and the full amount is due. Other cases must be considered as special circumstances, which are assessed case by case by Casa La Mariposa.

The guest is responsible for their rental period, and in the event of delays resulting from their journey, it is their own responsibility.

Alterations to the property – The guest may not carry out any alterations/work in the property. Violation of this will give rise to termination of the rental agreement, and Casa La Mariposa will demand the restoration of the property to its former state. This restoration work must be paid for by the guest.
Casa La Mariposa may, at any time and with prior agreement between the guest and La Mariposa, carry out (or have carried out) improvement work in the property.

Subletting –
The guest may not carry out any industrial activities or nuisance-causing, unhealthy, harmful or dangerous activities in the property. Nor may the guest transfer or sublet the property without the express written consent of Casa La Mariposa.
A violation of any of these obligations established by Casa La Mariposa constitutes grounds for termination of the agreement, retention of the deposit and compensation for Casa La Mariposa for the damage incurred.

Complaints –
If the guest has a complaint about the holiday home, the community or otherwise, the guest will report it immediately to Casa La Mariposa, so that Casa La Mariposa can offer an appropriate solution where applicable. If the guest finds the offered solution to the complaint insufficient, the guest must make this known immediately to the host of Casa La Mariposa on site and report it in writing within 1 week of the offered solution to Casa La Mariposa via email info@casalamariposa.eu. If the complaint is not submitted in time, it will not be processed.

Liability –
Casa La Mariposa strives to make the holiday pleasant and safe for every guest. Renting the holiday home is at the guest's own risk. Casa La Mariposa cannot be held liable for any form of direct or indirect damage caused by the guest or by other guests, loss and/or injury, including consequential damage, that may arise before, during or after the stay.

The guest is liable for damage incurred by Casa La Mariposa, its staff or representatives, and/or any part of the arrangement through their fault, as well as when the guest has not fulfilled their contractual obligations. Damage caused by the guest is recovered directly.

Casa La Mariposa is not liable for interruption of services, failure of appliances within the property, or nuisance caused by repairs or other work outside the property. Damage caused by (engaged) third parties and damage resulting from not following the instructions of Casa La Mariposa are not eligible for compensation.

Applicable law – Dutch law applies to every agreement between Casa La Mariposa and the participant. The guest must respect Spanish legislation and is liable under the regulations and laws established by the Spanish government.

COMMUNITY RULES

Welcome to our Enora community! We hope you will have a delightful stay and enjoy our beautiful residence. We highly appreciate it if you adhere to the rules, just like everyone else. Therefore, we would like to share them with you below.

1. POOL GUIDELINE

  • The pool is open daily from 08:00 to 22:00;
  • During pool maintenance, it will be temporarily unavailable;
  • This pool is unsupervised, so swimming is at your own risk.
  • Always shower before entering the pool and turn off the water after showering;
  • Apply sunscreen before entering the pool area to avoid stains on the tiles;
  • Running, making excessive noise, or diving around the pool is not allowed as both young and old want to enjoy the pool;
  • Children under 8 years of age must always be supervised by an adult;
  • Small inflatable devices are allowed as long as they do not hinder other guests from swimming;
  • Soft (beach) balls and small versions are permitted. Hard (soccer) balls are not allowed, including on the grass;
  • Topless sunbathing or swimming is not permitted;
  • Sun loungers cannot be reserved and must remain by the pool. Each section has four chairs, each accompanied by an umbrella. If you move the sun loungers, please return them to their original positions as there is no supervision. Also close the umbrella before leaving. Please put a towel on the sunbeds. Otherwise the sunbeds will get dirty from the sunburn over time;
  • Please respect the plants and communal gardens;
  • Vandalism to the pool or the urbanization, such as throwing stones into the pool or removing pool tiles, will result in a bill for the required repairs being sent to you;
  • Glassware is not allowed near the pool. Only plastic glasses are permitted.

  1. COMMUNITY GUIDELINES
  • Take all your waste with you when leaving;
  • Dogs must be kept on a leash in the communal areas;
  • Please clean up all pet waste within the community and on the streets surrounding the community;
  • Ensure that your dog does not bark excessively throughout the day. Other guests/owners will bring this to your attention if you are not aware of it yourself;
  • Barbecuing is only permitted in your own garden, as long as it does not cause inconvenience to other guests;
  • Smoking is prohibited, including in the indoor communal area of block 3;
  • Park your vehicle primarily in your designated parking space by your residence. If it is not available or you don’t have one, please park in the reserved parking spaces marked as “private parking Enora”. One car per owner;
  • Always close the outer gates immediately upon entering the community;
  • Close the inner gates from 22:00 onwards.
  1. TIME TO REST AND ENJOY

We all want to enjoy our leisure time here. Therefore, please ensure a quiet environment between 22:00 and 08:00. No loud noises after 22:00.

4.COMMUNITY AESTHETICS

  • Owners may not make any external modifications to their properties without prior approval from the community;
  • The list dated ( attached at the bottom) from EuroMarina provides a clear overview of permissible modifications without requiring approval;
  • It is not allowed to hose down the terrace on the upper floor as it causes water to flow down the walls, leaving black stains;
  • The installation of air conditioning units is permitted, but please be mindful of the noise and visual impact on other owners. Ensure that the air conditioning unit has adequate ventilation and is not placed too close to other objects;
  • All owners are responsible for keeping their gardens neat and under control. Trees, plants, and shrubs must remain within the garden walls and should not hang over neighboring properties or pathways. Leaves, seeds, etc., falling from trees must be cleaned up. Hedges should not exceed 1.70 meters in height. If these tasks are not adequately maintained, the community is authorized to maintain the garden at the owner’s expense;
  • TV antennas are not allowed;
  • Any other points require approval from the assembly. The community holds one general assembly per year, and the chairman or 25% of the owners can convene an extraordinary meeting if necessary.
  1. THEFT AND HOME SECURITY

ATTENTION! When leaving the property, please close all doors and windows, turn off the dryer, and switch off the air conditioning to minimize the risk of fire and theft.

Please adhere to these rules so that we can all enjoy a wonderful stay at Enora!
